Legal Question in Family Law in Illinois

Worthless Dad!

I have a 5 yr old boy and his dad has only seen him maybe 3 times. He left me and got married changed his numbers and even named his second son the same as our first. We were never married he dont pay child support dont call to check on him etc. he has signed the birth certificate and dna has been established out of pocket to prove to him he was his and still dont have anything to do with him. He also has an extensive background for domestic battery, like 5 or 6 counts. Is there any way I can terminate his rights so if I was to get married he could be adopted? And if he wont sign them over is there a way it can be done anyways?

Re: Worthless Dad!

It is possible to get a Court Order saying that a parent has abandoned his parental rights. If the father has notice and does not contest this finding, then you seem like you have a good case.

Even if you do not get such an order, you should be able to get sole custody of your child so that your ex will have very limited ability to cause trouble in the future.
