Is a 2nd offense of driving on a revoked license a felony?

My boyfriend was caught driving on a revoked license. This is his 2nd offense. He initially lost his license when he was 17 becuase of a DUI. He is now 24. He was first caught driving on a revoked license 5 years ago. He was recently caught again. When he went to court they told him his offense was going to be upped to a felony. He is the sole care taker of his 2 year old daughter. The mother is not in the picture. Would the courts alter their decision of prison time if they knew he was the caretaker of his daughter. I was wondering if they would possibly change it to time in county with work release to be able to provide for his daughter. What are the chances of that happening?

Your boyfriend needs to retain the best attorney he can afford as soon as possible if he is not already represented by an attorney. A good defense attorney might be able to negotiate a plea bargain which would be to your boyfriend's advantage. Also, from the facts that you give us it is not possible to tell whether your boyfriend might be eligible to have his license reinstated, which would impact any plea negotiations.
