Legal Question in Civil Litigation in Illinois

affidavits

What happens in a court case when an affidavit goes unanswered? Isn't there a law that says affidavits must be answered or something like that?

Re: affidavits

Affidavits are statements under oath. There is no law that requires an affidavit be answered or countered in any form. If someone believes facts to be different than that which appears in the affidavit, he or she can make an affidavit of their own setting forth the facts as they know it.

The judge or the jury will make a final decision as to who is telling the truth.

I hope this helps,
