Legal Question in Civil Litigation in Illinois

can animal control trap on my property without permission?

There is a stray dog in my neighborhood that hangs out in my neighbors yard- I didn't call animal control, nor have I been feeding, keeping, or harboring the dog in my yard. Animal control put a trap on my property without notifying me, came out one morning, there's a dog in a trap in my driveway. My boyfriend lets it out, we don't like traps, and initially thought it was the neighbor's. Now my boyfriend got a city ordinance violation for interfering with an officer- someone saw him let the dog out. just wondering how he should plead- obviously he did let the dog out of the trap, but should the trap have been there in the first place- and does it matter to his case. thanks

He should plead no guilty, if he did not know or there was no way of knowing the who had set the trap. For all you knew, it appears that your boyfriend was helping prevent a case of cruelty to animals.

Good luck,

I agree that if he had no idea who placed the trap then he should plead not guilty. I have never seen a trap so I have no idea if they are marked with any ID information.

The other item that bothers me is that this was placed on your property without your consent. I would inform the judge/administration hearing officer of this.
