Name change

Although I live in Indiana I have a legal situation in Illinois. I just wanted to know what steps I need to take as far as my childrens name being changed without my consent or even any knowledge of any hearing. I found out that names were changed when the irs alerted me that social security numbers do not match with name provided on taxes so I went to a public information website for that paticular county and found out for sure. Illinois law requires me as the father to be notified by hand delivery of such hearing(i.e. certified mail) I have not even recieved a court order. I am listed on the childrens birth certificate in Illinois and I also pay child support. I have never been convicted of any crime. I do not understand why the circuit court in Champaign County would allow this to happen. Thank you in your time.

Re: Name change

If the custodial parent does not know the whereabouts of the non-custodial parent, the notice can be published for 3 weeks in a newspaper.

If the custodial parent did know your whereabouts but failed to serve you with notice or obtain your consent, you can try moving to vacate the name change order in the court where it was entered.
