how can i collect money owed to me?

i lent the man who lived with me for years money to get a

semi-truck and he was to pay me back. I have cancelled check showing that i paid for the truck and i also have 2 checks that he gave me as marked as payment totaling $220.

the truck cost $16,500.00 bought in oct/nov 2000. he left the household in 2002.the checks for $220.00 came in the last 3 months we could make a good living but when he was here he didn't even drive put in my driveway and cop's gave me a hard time. i supported him for many years me working two jobs to keep food on table and its not any eaiser now. and he is making $1500. a week now using the truck i paid for while i slave to make 570.

in two weeks. if you can see any recourse that i can take

please advise he really owes me over $20.000. we had a list we kept for stuff he borrowed from me i have this hidden. he had to buy plates and the truck broke down so i had help fix it. . its only me and sll i do is pay. he returned to live with his parents and one of his brothers drives the truck also so they get rich and i get nothing. thank-you for your help if you can help

Collecting money lent to a former boyfriend.

Based upon what your submission states, you have a good case for a lawsuit to be repaid the money you lent. Under the cause of action for �money had and received,� the law presumes that money given to someone should be paid back. The defendant who claims that the money doesn�t need to be paid back has to prove in court why that should be so (e.g., a gift, payment of a bill, etc.). In your case, once you have established that you paid for his truck (you cancelled check is an excellent piece of evidence), the burden would shift to him to explain why it shouldn�t be repaid to you. If he claims the truck was a gift, he�ll have to prove that.

You might also have a good claim for the �stuff he borrowed.�

Because the amount of money you seek is well over the small-claims limit in Illinois ($5,000) you�ll need to file and prosecute a regular civil suit. Perhaps a lay person could do it, but an experienced lawyer is far better prepared to handle such a case. Seek out an attorney in your area.

Your options regarding how to collect the money really depends on whether he signed a contract or agreement to you stating he would pay the money to you for the truck.
