If my neighbor has irrevocably damaged 50' of hedge on my property, how do I go about legal action to sue to be made whole? Said neighbor would be leaving the USA for his home in the Phillipines in two days.

Re: Damage to property

See if your homeowner's policy covers this kind of thing. It might be better than having to pay for the replacement yourself.

Re: Damage to property

I am assuming your neighbor owned his property.

You have two days to file a lawsuit against the man, and serve him with the service of process. Once done, then the insurance company will take over and your neighbor's presence will not be necessary...

Although, if he does not cooperate wit his insurance company, they will deny coverage.

None of the choices you have are any good.

Good luck,

Re: Damage to property

You have two days to serve him with lawsuit papers. You did not mention if he is leaving permanently or if he owns the neighboring property. If not, you may have difficulty collecting on a judgment.
