Legal Question in Civil Litigation in Illinois

damages awarded in criminal case?

Our two employees embezzled from us and will soon be charged. While we expect the State's attorney will ask for restitution, can they be held liable for damages to our business or do we have to go to civil court?

Re: damages awarded in criminal case?

Criminal court can order restitution, but it is never the same as civil court.

Also, civil court judgment subject to bankruptcy laws, criminal restitution is not.
