Legal Question in Civil Litigation in Illinois

on December 9, 2013 a man named Alex Perry from Right Way Signs was installing a sign on the side of our apartment building. His father was driving the work van and backed into my car, causing over $500 in damages. Alex asked for an estimate for the damage so I could be compensated. He is now refusing to pay without proof that the vehicle has been repaired. I have since traded the damaged vehicle in and lost money on my trade-in as a result of said damage. Am I still entitled to the money in small claims court even though I no longer own the vehicle in question?

Yes--their obligation to pay is independent to whether or not your decide to repair your vehicle or not.
