Legal Question in Civil Litigation in Illinois
Denied Claim
My condo was severly flooded by the upstairs unit. The person filed a claim and we were given a claim number by Allstate. After 3 months of us contacting Allstate, a demand for payment letter and finally a complaint with the Illinois Division of Insurance, the claim rep called and said we are being denied because we filed a complaint with the illinois division of insurance. I honestly do not know what to do now. I dint know that they could deny me because I filed a complaint with a regulatory body. thank you

Re: Denied Claim
They absolutely cannot.
This is in violation of Illinois Insurance Law which requires a good faith effort to dispose of claims and requires adjuster to fairly and reasonable assess the claims filed.
Making a complaint with Department of Insurance is in no way consitute a reason for denial.
Contact my office so we can discuss this further. Allstate has been involved in many unsavory dealings and so it does not surprise me that they have done what you say.
I hope this helps,

Re: Denied Claim
They cannot deny you because you filed a complaint. you can sue them for bad faith.
