Legal Question in Civil Litigation in Illinois

Depositions

I recieved a letter asking to give a deposition on an event that happened over 5 years ago. Am I required by law to show up for this even though I remember very little?

Re: Depositions

If you have been subpoenaed, then you must attend. If it is simply a letter from an attorney, you should call them and tell them that you do not remember anything. If they still want your deposition, keep in mind that 1) it is your civic duty to help in the implementation of justice and 2) you are entitled to your transportation costs and 3) you can ask that the deposition take place at a place and time convenient to you.

It does not matter whether you remember things or not. Answer the questions the best you can and if you do not remember, simple say so.

I hope this helps,
