Legal Question in Civil Litigation in Illinois
Dog adoption
We purchased a dog through anti-cruelty society and have had the dog for 3 1/2 months. We got a call telling us that the original owner wants the dog back. THey have a police report stating that the dog was stolen. But in the report it just says a brown and whit huskey(could be the same dog). No dog mircochip was in the dog when it was brought to the society and the dog's mircochip is registered to us. Do we have to give the dog back!

Re: Dog adoption
Do you still have the documents you got from Anti-Cruelty when you adopted? Did they inform you about having a policy of returning dogs to owners who change their minds? I checked their website and found nothing to that effect. When you adopted that dog, you agreed and represented to Anti-Cruelty that you would tend to the dog's health, have the dog neutered, provide an acceptable home, etc. Assuming you have upheld your end of the bargain, an attempt by Anti-Cruetly to take the dog away would appear to be a breach of your contract with them. Don't give the dog back unless there was a provision in the agreement you made with them that says you have to do so if the original owner changes his/her mind.
Re: Dog adoption
Before you begin thinking about giving the dog back, the one's claiming that this is their dog must prove that your dog is indeed the one that was stolen. The proof must be something more than just a "brown and white huskey". It has to be something verifiable. If they cannot prvide you with such a proof, that is your dog and no one elses.
I hope it helps,
