Legal Question in Civil Litigation in Illinois
exparte judgment
I am trying to enforce an exparte
default judgement against someone whose only collectible asset seems
to be an automobile with a balance owed of $6, 244.00. Can I have the
automobile seized as a result of the judgment or is the bank the legal
owner of the automobile which would prohibit me from having the court
take possession of the car for sale and repayment of the debit?

Re: exparte judgment
First you need to determine the current market value of the car. The banks lien has first priority, in other words they get paid before you do. I suspect but am not sure that if you take possession of the vehicle, that you may be responsible for the debt owed. You probably should contact a debt collector attorney and set up an appointment.
