Legal Question in Civil Litigation in Illinois
Failure to ackowledge debt repayment
I loaned my son-in-law $21,000 over a 3-4 month period when my duaghter was hospitalized due to cancer related complictions. All bills were several months behind. My daughter passed away. I tried on several occasions to talk to my son-in-law about repayment. All checks had 'loan' in the memo section. Y son -in-law would not acknowledge any converation about any repayment. A medical malpractice lawsuit was initiated regarding my daughters death and a settlement was reached. I wzas paid the $21,000 about 20 months after the initial loan. Can I file a civil suit in small claims court requesting interest for the extended 20 month period of time for repayment?

Re: Failure to ackowledge debt repayment
Yes. You may file and request payment of interest based on an annual percentage rate of %8. However, you may have a hard time doing so because from what you have written, you did no specify before hand that you wanted that 1) the loan be repaid within a certain period of time and 2) the interest rate.
It looks like a big waste of time.
I hope this helps,
