faulty repair job

we had a porch rebuilt to fix some water damage. the work was completed but when it rained it still leaked. the people came back to fix but they did not go back far enough to fix the leak. now they wont come back to repair the fixture. should i send a letter of demand for repair or should i head straight for small claims court?

Re: faulty repair job

What does your contract say? I assume you had a contract that describes the nature of the work to be performed. Does the contract say that the work to be performed was to rebuild the porch and fix the leak?

I would send them a demand letter for repair and send it via regular mail and certified mail/return receipt requested. If you receive no satisfaction then file the lawsuit. However, keep in mind that the questions I stated earlier are probably going to come up at trial so make sure you have proof of the repairs you contracted for.
