If you know the identity of the party that took your information and spent your money, it would be appropriate to bring an action for conversion against him or her. You can add the dentist as a party under agency theory (his agent took your money while acting in the scope of his/her employment). However, if you haven't done so already, you should initiate a police action for theft. It is likely the outcome of a criminal trial will be to order the defendant to pay you back the money you are owed from the theft. However, if that does not occur, then bring your civil claim.

Yes--you have several causes of action against the doctor's office. They should have safeguarded the sensitive credit data you entrusted in their hands. They have been careless and they should be held liable for the damages that they have caused you.
My office can help you out, if you so choose.
