Legal Question in Civil Litigation in Illinois

friend refuses to pay back loan

I loaned a friend of mine $500.00 Jan 2000, I have the cancelled check and ''loan'' written in the memo section of it. We didn't discuss an actual payback time because this was somewhat of an emergency. I relied on him to pay me back within a reasonable time but he has failed to do so. I asked him last year for the money he said he was struggling and couldn't pay it, Ive waited another 9 months and asked again and realized this person is giving me the run around, we fought and he basically told me he's not going to pay me anything. I am furious at his response and truly believe he does not intend to repay his loan. What can I do to resolve this matter? Do I have a leg to stand on with just the cancelled check? Thank you.

Re: friend refuses to pay back loan

Yes, you have a leg to stand on. I would suggest you try using an attorneys' letter to convince him he should pay. Aside from that, you can then sue him in small claims court.
