Legal Question in Civil Litigation in Illinois

My friends lawsuit just settled. She had no intention on sueing anyone. Nevertheless she counter sued because we felt it wasn't her fault for the motor vehicle accident. The original agreement was that she would pay all cost involved in the case around 2-3 thousand dollars and the attorney would get 33 1/3 after the case settled. The attorney now doesn't want to reimburse her the costs. He said you agreed to pay all costs. Nevertheless if he would of paid the costs he would recover them and also get 33 1/3.
