Legal Question in Civil Litigation in Illinois

Home Breakin and Theft

Had a live in girlfriend that I had purchased her home. Later we grew apart and I told her to leave. She left the premises and a week later came back while I was at work and removed almost everything in the house. Her belongings as well as mine including built in appliances; dishwasher, stove, etc. The police refuse to do anything claiming that she had occupancy and until evicted she could legally do so, even though I had the locks changed and she obtained a locksmith to enter the residence. What are my legal rights, the local police will do nothing.

Re: Home Breakin and Theft

You can sue her for the damage to your property, tresspass, and for "conversion," which is the civil equivalent of "theft." Call me if you want to sue her. Larry Stein (630) 221-1755.

Re: Home Breakin and Theft

Based upon the facts that you have given, it is likely that she committed a crime. It is possible to recover from her on a civil lawsuit, but it may also be possible to sign a complaint for a criminal charge and the disposition of that case may include restitution. If you wish to discuss this further, please call 630-257-8280.
