Legal Question in Civil Litigation in Illinois
home repair
I have worked with a contractor for numerous home repair projects and have had a wonderful relationship with my contractor. In april of 2007 I received a check from my mortgage co for $16,000 for which I planned to use to complete projects and my and my mom's house. I hired the same contractor to do the following, new concrete front walk and 1/2 concrete of back yard which is complete, put up back fence which is complete, landscaping front lawn and side of house not done, gutters to garage not done, build shed under back porch not done and a deck in the back yard not done. My mom and I signed the check and the contractor took the check to a currency exchange that he says he does business with and we gave the ok for the check to be cashed by the contractor. I faxed a letter stating the contractor was hired by me to do work and to cash the check. He gave me $2,000 back upon my reguest and said he would start work immediately It has been over 3mos and He has not completed the work. He never shows up when he says he wll. I have called him numerous times he neither doesn't pick up the phone or return my calls and when he does he is belligerent and angry that I question his work. I need a lawyer

Re: home repair
Basically, you paid him $14,000 in advance and he has not finished the work. It is unclear from your message whether he has finished $14,000 worth of the work. A lawyer's letter may get him to finish the work. It is not clear whether you have suffered any damages without knowing more about the contract. You may contact me if you wish to discuss the matter further.

There are plenty of lawyers in Chicago, you can find one in the phone book, call the bar association, or ask around.
You should send the contractor a demand letter stating the facts of the deal, the work that he was supposed to do, the amount you paid him, etc. Give him a date by which he must either finish the projects or return your money. Send the letter certified so you have proof he received it. If he doesn't respond, then you will have evidence that you made gave him one last chance to perform under the agreement and he didn't.
After that, get a lawyer and sue.
