Legal Question in Civil Litigation in Illinois

Horse Sale

I bought a 2003 paint stallion 4 months ago. The man promised me papers and a current coggins in exchange for the $5000 plus he trailored the horse at no charge. Now the 4 months has passed and he has yet to get the papers. Apparently they've suddenly decided to register some of his babies and can't transfer his papers until that's done. He also brought the horse without a coggins. What do I do at this point? I've been unable to move the horse to the stables I'd like because he was going to be in with mares to pasture breed and can't now because they won't breed him without papers. Therefore I've been paying extra to board him somewhere else! Can I take him to court over the papers and money? I'm at a loss because the horse is virtually worthless without papers.

Re: Horse Sale

Yes. You can take him to court. I suggest that you hire an attorney first, and see if a letter that demands full performance and the damages for the delay gets some results. My bet is that you withh have the papers and coggins quickly, but not the damages. Good luck.
