Legal Question in Civil Litigation in Illinois
My husband had an engine rebuild by somone who owns his own shop. My husband has been paying him in increments when he gets paid. The guy who rebuilt the engine has had it and has been working on it for about two months. He is now done with the rebuild and is demanding full balance payment from my husband and has even sent a threatening letter to sell his engine if he doesnt pay him now. My husband and the guy had verbally agreed before starting the rebuild that my husband will pay him when he can until it is paid in full. He had no problems with that and was very willing to work with us on it in the beginning. Now he is demanding and threatening us. We didn't sign anything, it was just a verbal agreement. Also, it hasn't even been 6 months since that man has had my husband's engine. In fact, he just completed the engine last month. What legal rights do we have and does he have the right to sell our property?

Your situation is a very difficult one to prove. The mechanic may well not agree with what you say he and your husband agreed to. Also, if there were not sufficient terms agreed to to form a verbal contract then there may be no legal agreement. Your best bet would be to try to work out an acceptable payment schedule. Next time put it in writing.
