Legal Question in Civil Litigation in Illinois

My husband and I were trying to secure a vacation resort for spring break down in Orland FLorida for a 5 night stay (we live in Plainfield Illinois). This resort offered a special of 5 nights and 2 adult tickets for one of the theme parks in Orlando with the stipulation of going to one of their resort vacation presentations. After making the verbal agreement iwith one of the representatives he sent us an invoice for the vacation package with where we were to stay and the duration. I signed what was required of me on the invoice and sent it back and our credit card was charged the full amount of the vacation stay. THe invoice indicated we were to receive our hotel vouchers 5 business days after the credit card was charged, we waited and wating and then called the company and it was not until then they sent over the voucher. On that voucher the vacation stay had changed and we were put into a different place. We tried several times to contact the company and was often told to call back, call back, call back they were trying to fix the problem. With time drawing near we finally told them to refund our money and send a e-mail confirmation when it had been done, that their service was un-acceptable and we wanted our money back immediately. We were told on two separate occassions that they would refund our money, we even spoke with a manager and she told us that she was going to refund our money that we needed it to secure another place. THey lead us on for almost a month and that we needed to secure a place to stay because team was getting very close for our Chicago road departure. Unfortunately, they have yet to do so., causing us very unstable travel terms now, I am beyond frustrated and would like to know what can we do about this. I have record of all of our correspondances via e-mail and fax. We are to travel next thursday, and had to borrow money to secure a hotel stay in Orlando, What can we do?

Tthere is a reasonably good chance that you do not need to hire an attorney, so I would hold off on contacting David until you check out other avenues.

You should contact your credit card company asap. The credit card company should have a procedure for charging back the charge against the resort company and giving you a credit. However, generally these things take about 60 days or so.

You also should contact the Illinois Attorney General's Consumer Fraud Division.
