Legal Question in Civil Litigation in Illinois

internet defamation

If someone copied and saved pictures of me, and made a fake facebook profile of me saying things that are not true for the most part and putting up wrong pictures of me, can I do anything about this? He used a fake email and did not admit to doing it, but is there any way to trace him in doing it? I believed he hacked into my original account and I had facebook delete that account permanantly. but as far as this fake profile goes can anything be done for him defaming my character?

Re: internet defamation

Yes-- If your character has been placed in false light and that there are false information that someone is disseminating to third parties, you do have a cause of action. You may also be able to have Facebook remove the offending site and in order to find the owner of a n email, you will need a copy of the email's headers so that the IP can be identified. Once the IP has been identified as to what ISP it belongs to, then it is a matter of subpoenaing the records to find out to whom the IP has been assigned.

I hope this helps,
