who is libel for what

our truck was driving on state highway when second vehicle pulled onto highway from county road and t=boned the truck.our insurance had lapsed within the last month so we received ticket for that. Later find out second vehicle 's insurance wasn't in force either.Since the accident was his fault is he libel for our truck and his vehicle?
