Legal Question in Civil Litigation in Illinois
i had a long distance relationship/ boyfriend/friend with an old school mate- he sent me money to get an apartment, while he lived in another state, before he came home- we broke up- now he wants the ring, a sweatshirt of his back( which i returned to his dads) and he wants the 1,000 he gave me to help get the apartment- i am still stuck with the lease and i never put anything in writing to tell him it was a loan- he gave it to me- now he is trying to black mail me - and stalk me since i returned to my estranged husband just to get the money- does he have a legal leg to stand on? please advise?

Yes, he certainly does. If you gave you a check, it would be very easy to prove he gave you the money. If you claim it was a gift, and he claims it was a loan, it would be up to a judge (assuming he sues you) to decide which one of you to believe. If he gave you a ring in contemplation of marriage, you will probably be required to return that to him as well. Blackmail and stalking are serious allegations, which if true should be addressed as well.
