Ltr from atty regarding lawsuit for $700 owed to an ex-coworker

An ex-coworker who was fired from my place of employment due to fraud had lent me money 2 years ago. I owe him $700 and can not pay him due to my current finacial status. When he lent me the money he stated pay it back when you can. Well last year his house in FL was completed and he moved and then demanded pmt in full. No written contract was executed and now he has an attorney sending me a letter threatening a lawsuit and invoking the courts to demand action from me to pay! Plus I have his father in law harassing me at work while I am extremely busy with patients harrassing me to speak to his son in law or daughter regarding the money owed. Can he do this? What are my rights? Thank you.

The Illinois Fair Debt Collection act requires that collection calls not be made outside ordinary business hours, and not be made in a harassing manner. You should notify in writing the attorney of the harassing calls you have received and demand it to stop--they have to comply with the law.

Further, if you agree that you have borrowed money and agree that you must pay it back, just contact the other attorney and tell him that you like to pay but cannot pay all at once. Enter into a payment agreement and pay the money back.
