Legal Question in Civil Litigation in Illinois

Personal Property/security deposit

Over a year ago i moved in with my boyfriend. His former girlfriend

had

lived in the apartment about 3 months before she was asked to leave.

Police

were involved. He ended up signing a new lease. She retrieved most of

her

belongings but now it has been about 15 months and she is wanting a

mattress

and security deposit. What is the statute of limitations on these

items?

After 15 months isn't it passed her time to demand these things back?

Please let me know ASAP.

Re: Personal Property/security deposit

"Statute of limitations" refers to the time in which one has to file a complaint in a court of law in order to initiate a lawsuit; therefore, no "statute of limitations" applies to retrieval of one's property from someone else who has been holding it. 15 months is not going to be sufficient time to deem her deposit or her personal property abandoned. If your boyfriend signed a new lease alone, where the old lease was for him and his girlfriend, then he owes her her deposit money back. If the mattress was indeed hers, then give that back to her as well. She is rightfully entitled to it as well as the deposit.
