Legal Question in Civil Litigation in Illinois
No reason to garnish wage
I owed a creditor money, but we agreed to a settelment which I paid in anuary. This agreedment involved upon payment all action to garnish would stop imediatley. I called the creditor they promise to contact their attorney to stop the action and told me to contact my payroll department to refund my money, this was in the second week of March. Now in the scond week of April they have taken money again which they have no reason to since I paid infull all the money we agreed to. This action has futher damage my credit, as well as placed my job in jeprody. What action can I take to stop this illeagal garnishment in adittion to removing it off my credit report.

Re: No reason to garnish wage
Contact the creditor (or better yet, the attorney) and explain what happened and that you need them to take the necessary actions to make sure the garnishment ceases. It's probably just due to a miscommunication or lack of communication to your payroll department. There should have been an order entered that memorializes your agreement and payment of all funds, try to get a copy of that. You will need to submit the order to the credit reporting agencies (Trans Union, Equifax, and Experian) to try to straighten this out with them.
It's not an illegal garnishment if it's connected to collecting a debt you legitimately owed.

You need to contact the attorney and the creditor and file a satisfaction and release of judgment with the court along with an order terminating the wage order. You should then send this to your payroll department and credit agencies. These are things that they should do, but do not rely on them, do it yourself.
