Restarining orders

In Illinois, what do I need for, and how do I get a restraining order against someone? I may need one to keep another person away from.

Re: Restarining orders

Most Illinois courts provide a service run by individuals titled "court advocates". If you call the Circuit Court Clerk's office of the county in which you live, and ask for the court advocate, they will give you the proper direction. Court advocates assist individuals in obtaining "Orders of Protection" under proper circumstances.

Re: Restarining orders

You need to go to court and file an application for a restraining order against that person. Note that you will have to explain fully why you wish that person to be away: harassment, violent acts and so forth... just saying that you do not like that person is not enough.... you must show some sort of danger or undue harassment. You can ask for a restraining order on behalf of yourself or on behalf of minor children.... however, if they person you are trying to protect is over 18 with full mental capacity... then you are not really the interested party and he/she has to file by him/herself, unless the person you want to stay away is also harassing you and so forth. Good luck.
