Legal Question in Civil Litigation in Illinois

Small Claims

A friend took me to small claims court about a week and a half ago. I agreed to the amount that I owe him, and we were sent off, and we were told to make payment plans on our own. I currently don't have the money to pay him back, so I haven't made any payments. He called me today and told me that he put a warrant out for my arrest. What should I do?

Re: Small Claims

You need to go to court and straighten things out. If there is a warrant on you, that means that he has gotten a judgment, and has now moved to collect and you have failed to show up in court.

It is also possible that your "friend" is not telling you the truth. Call the Sheriff dept. and inquire about whether there is a warrant for your arrest.

If there has been a judgment taken out on you and then proceedings to collect the judgment, you should have received notice of all court days well in advance If you did not get notice, make a motion to the court to vacate the judgment and strike the warrant etc...

You may want to get your self a lawyer. If you cannot afford one start by the Legal Assistant Foundation who, if you qualify, will provide you with free legal assistance (http://www.lafchicago.org/).

Good luck.
