Legal Question in Civil Litigation in Illinois

SOL Question

I was sexually assaulted by an E.R. doctor in 2001. I won't go into the details of the assault here.I didn't do anything as far as criminal or civil. I didn't KNOW for sure that I was assaulted. When a doctor does this you try to convince yourself that it wasn't . It was after all A DOCTOR. My sister was telling me of a friend of hers that won't go to the E.R. anymore when this one doctor worked. Then she told me what he had done to this girl. The exact same thing he did to me. This happened to her 2 yrs ago. After hearing the details of that assault I KNEW THEN I was assaulted. MY question is when does the SOL start. In 2001 when it happened or when I KNEW I was assaulted which would be last month? I'm mad as hell at myself for not listening to my gut.Is this even worth seeing an attorney about since it was so long ago? Also, if it is worthy,what kind of attorney do I see? It happened in IL. Any advise would be appreciated on this subject. This man must be stopped.

Hello. In my opinion the statute of limitations begins to run when you first became aware of the sexual assault. Based upon what you have stated here I think it is worth investigating. However, you will have

to show by clear and convincing evidence the basis for your claim that you were sexually assaulted. It can be done, but the evidence must be

more than a mere hunch; although circumstantial evidence can be used.
