i have been subpena in a labor union case i told the person who issued the subpena that my auto was damaged before and it may be damaged again who is liable if it's damaged on property since i'am forced to do this

Your only duty under a subpoena is to make an appearance at the time and place specified in the subpoena. If the subpoena also suggests that you have documents in your possession, you would testify at the deposition how the documents came to be lost and that you do not currently have the originals or any copies. I'm not clear about how property damage to your automobile is relevant to the subpoena.
