Legal Question in Civil Litigation in Illinois

being sued for property stored

We are being sued for $50,000 for items we junked that were being stored for a friend while he was remodeling his house. We didnt ask for any rent and the items were left in our building for 6 yrs. we contacted him and asked him what he wanted us to do with his stuff as we were cleaning up, he told us to junk it its been quite awhile and he's very sick, and now he's suing us saying we just dumped it without his consent. What chance do we have?

Think about it this way--how will he prove that he did not tell you to junk his stuf... 6 years is a lot of time to leave stuff at someone's home. If you didn't charge him rent, you may as well do it now! File a counter claim for unpaid rent!

I hope this helps,
