Legal Question in Civil Litigation in Illinois

summons server procedure

on a day off after being home all day someone starting maniacally knocking and ringing my bell. Didn't answer. next morning same thing. Didn't answer. Day after this person appeared early AM and served it to someone other than me. Didn't request signature. Only asked if I was home. I'm only one metioned on summons. What do I do? Can I file a complaint? How do I let the court know it wasn't served to me.

Re: summons server procedure

You were served if:

1- the person who received the paperwork is a person over the age of 13 and leaves at that address; or

2- you were obviously attempting to dodge service and you have been served by proximity.

You should think about answering the complaint otherwise all allegations will be deemed as true and judgment will be entered against you as prayed for in the complaint.

Good luck,
