Legal Question in Civil Litigation in Illinois

Threatened to be sued for gifts received.

My ex-boyfriend bought my house, car and furniture but we did not have a signed agreement that we both owned these items. In fact the titles of the house and car are in my name. Now he's threatening to sue me for these things. Does he have a case and what are his chances of winning?

I'm not sure if I understand your question, but any transactions for land over $1,000 must be in writing. If you had an oral agreement in regard to personal property items, he could probably recover under a breach of contract theory since there may be an oral contract.

As they say, possession is nine/tenth of the law. So far as the law is concerned, if your name is on the deed of the house, and the title of the car, the house and the car belongs to you. However, in equity, your ex may have a claim on the house and car. As you know, all cases should be evaluated on their own facts and with the limited facts you have given it is impossible to give any more accurate response.

You should speak with an attorney in your area as soon as possible. It's the best money you may have to spend.
