Legal Question in Civil Litigation in Illinois
An ex that I have been in touch with for a while is now claiming that I am stalking him, probably because his girlfriend found out that we were still in touch. He is also telling my family that we never had a relationship and that I am just obsessed. He told my family that I got his number and address from other friends when he actually gave both of those to me. Can I sue this person for defamation? He is also telling the same story to his family and new girlfriend. But he gave me mixed signals throughout these past few months and now he is saying that it's me who is annoying him. He claims he has lodged a complaint with the police as well saying that I am harassing/stalking him. Would his complaint hold water? Your input would be very helpful at this point. Thanks.

Hello. This is a very serious matter, and yes, you could file a lawsuit against this gentleman for slander. Of course, it will be necessary to establish damages and you will need witnesses to substantiate your claim that he slandered you. If he has gone to the police and made out a charge of stalking, it will be necessary to defend yourself. However, based upon the information that you have given, I think it is unlikely that a prosecutor would bring charges against you. I will be happy to discuss this further and in more detail.
