Legal Question in Civil Litigation in Illinois

Tree on the border

There is a dead tree that sits on th border with my neighbor. Originally, it was only on his land, but now the trunk is about 90% on his land 10% on mine. Branches and leaves cover my roof. Who is responsible for the cost of removing the tree and the cost of removing the branches. I am 68 and cannot personally clean off the roof as I am disabled. Thank you for your help.

Re: Tree on the border

The last time I researched this issue the law in IL was that in the situation you describe the tree belongs to your neighbor. You can trim any part of it that is over your property, at your expense, but you cannot do anything that kills the tree. Perhaps a friendly approach to the neighbor might accomplish more than the law allows you.
