Legal Question in Civil Litigation in Illinois

Uniform gift to minor act

For 17 years I have been saving for my son as the Custodian in a Illinois UGMA. Soon he will be 18 and is not financially responsible enough to handle this money. This 6 figure amount was intended to be used for college, yet I fear it would be wasted. How can I legally withhold this money from him until he matures.

Re: Uniform gift to minor act

First I believe the age for distribution is 21 and not 18. Double check that.

Second, the funds placed in UGMA are no longer under the control of the person who has gifted the funds away. Once the funds are distributable to the beneficiary he or she can do with them whatever he or she wants. That is the purpose of this.

I hope this helps,
