Legal Question in Civil Litigation in Illinois

Hi, my name is Wanitha, I am one of 4 founding members of a social skate club, we have been in existence for 6 years, 3 months ago 3 of the other members resigned from the club and want us to retire the name and stop using the name and current logo, there is nothing in the by-laws that says just because they leave we have to shut down the club, the club has it's own FEIN # on file with the IRS under the Club's name, do the remaining 12 members have the right to continue to use the name? Please advise.

Wanitha

This is not the sort of question that may be answered in this forum. You need to go and have a face to face conversation with an attorney who can review all the documents, letters, bylaws etc... that you have and then give you a legal opinion about where you and your fellow members stand versus the members who have left and whether they have any standing to make the demands they have made.

Although I do not do this sort of work, I know attorneys who do. If you like, you can contact my office and I can refer you to an attorney who may be able to help you out.

I hope this helps-

I agree with Nima. There are a number of things to consider before an answer can be provided.
