Legal Question in Civil Litigation in Illinois
Wedding Photographer
Wedding Date Sept. 2007. Contract signed does not state timing for pictures or album, 40 pg custom designed album, 75 proofs, 1 16x20 wall portrait. Verbal: we asked if we could choose album pictures, told not possible (have since found other couples who did pick own pictures not written into their contract either). Pictures were not posted on web site until 7 mo after wedding. Received album 8 mo after wedding. Album contained 50 pgs to make up for time issue. Did not like most pictures in album. Album fell apart when removed from box, some pictures scratched. Sent it back with in 1 mo requesting many changes and for scratched pics replaced. Verbally told only 6 changes would be accepted. Told changes would not be made. Went back and forth for a little while then heard nothing for the last few months. Told today (4 mo after requesting changes) that all changes would not be made, only 6 changes that we want. Also told 4 pages (of the 10 extra) would be removed to eliminate stress on album. Live in IL photographer is in WI (I think small claims in only for monetary in WI). What can be done legally? Do we have any type of case? Prefer not to get any pictures.

Re: Wedding Photographer
First question: Was the wedding in Illinois? If not, then you probably need to sue in Wisconsin.
I cannot comment about Wisconsin law.
Assuming the case was in Illinois, I would want to have a look at the contract and talk to you about what was said when you hired the photographer. Depending on how bad the service was and some other details you may have a case for breach of contract. The key question will probably come down to whether the photographer was acting according to business standards in the profession.
