Legal Question in Civil Litigation in Illinois
Wrongful Termination Suit?
I was fired from a position because of
anti-union motivation. The case was
heard before an ALJ and it was
determined by the ALJ that my firing
was indeed a violation of the
Education Labor Act. The ALJ's
decision was recently affirmed by the
Educational Labor Board. Do I have
a wrongful termination suit and can I
seek punitive damages?

Re: Wrongful Termination Suit?
Sounds like you have a valid wrongful termination claim and you may be entitled to punitive damages if the termination was egregious, but to make a determination of the merits of your case, all the facts must be known. Find an attorney in your area that specializes in employment issues and discuss your case with him or her. If you aren't sure about how to find one, contact your local bar association, they will refer you to a specialist in this area. Good luck.

Yes, it sounds like you have a valid claim. Importantly, the relevant statutes would likely provide for an award of attorneys' fees, so, assuming you would prevail, you could obtain reimbursement for reasonable attorneys' fees. What did the ALJ order? Were you compensated for the loss of income?
