Legal Question in Immigration Law in Illinois
Hello,
My first H1-B is expiring on Sept 12th, 2010. I am planning on travelling and entering back into the country by Sept 2nd, 2010. Will that be an issue at the Port of Entry since it is very close to expiry. I can show my employment letter and also show that my second H1-B petition has been filed.
Thanks
Sumith

Hello:
As long as it is still valid, you should be able to enter.

Hi,
No problem at all, since the documents that you are carrying with you suggest that you have earlier maintained your H1B status, and that you are not entering the U.S. with only 10 days remaining in visa status without plans on extending your H1B status.
