Legal Question in Immigration Law in Illinois

illegal immigrant

Can an illegal immigrant who has been in the US go back to the country of origin and return any legal way without marrying a US citizen or having a green card? Are there any waivers available that a US citizen can complete to help in the process of getting an illegal immigrant back to the US?

Re: illegal immigrant

Your question is a loaded one and requires a full understanding of your previous interactions (if any) with the INS/CIS and/or the Department of Labor (and/or its designee). It also depends upon your background and what country your are from and how long you have been in the United States. Re: illegal immigrant

I am not aware of any such "waivers" which would allow such a person back(legally)into the United States without her going through the same standard procedures involved in applying either for nonimmigrant or immigrant visa status which any other individual from this person's country of origin would have to follow in order to gain legal entry into this country.

As a matter of fact if it can be determined that the illegal alien has been in the United states

for a year or longer, it's my understanding that under current law the person is automatically barred from entry into the U.S. for the next 10 years.

Re: illegal immigrant

If the alien has been in the US for more than 180 days, leaves and then tries to re-enter the US, there are bars which apply to said entry. Depending on the time frame, the bars can be 3 or 10 years.
