Hello!

3 years ago I came to visit my grandma in Russia(I was 15 years old) now I am 18 and I have a baby 10 months old and I want to come Back to the US. I have a greencad for 10 years but it is not here with me (my mom has it ,and wont send it to me) what do I need to do to come back with my baby?

Dear Inquirer:

Most likely you have abandoned your status, as the USCIS/DOS views absences of more than 1 year, without excuse, as an abandonment of your status. Generally, if a green card holder has a child outside the US and brings the child to the US on the next trip back home, the child will also be admitted as a green card holder. Since you remained out of the US for more than one year, however, and I assume without a reentry permit, you would need to be able to establish that you never intended to stay out for more than one year and circumstances beyond your control prolonged the trip.

If you have been outside the US for 3 years, it is possible that US immigration authorities will decide that you relinquished your permanent residence, unfortunately. If you cannot get the actual green card to return, you need to visit the US consulate or CIS office nearest to you and request a Transportation Letter (Boarding Letter) This is used by permanent residents who need to get back into the US when they have lost their green cards. Hopefully you can explain to the immigration officer why you left the US and that you did not intend to abandon permanent residence.
