Legal Question in Immigration Law in Illinois

Laid off back home, Can I file for green card while in India?

Hi,

I was recently laid off and since unable to find a next one in time, hence I returned back home. I have a Ph.D. and masters in engineering from US university with about and year of work experience, I've lived in US for nearly 8 years. Is it possible to file for green card while in India through EB2-NIW category? If yes what are my chances of success?

Thanks

-ss

Dear Inquirer:

It is possible to be petitioned for a green card from outside the US, however, you will need a new US-based employer to petition you. Your chances for success, with or without a NIW, will depend on what type of engineering work you do and the location of any job offer.
