Legal Question in Immigration Law in Illinois
Marrage
My girlfriend and I would like to get married, however, I have just graduated from college, and am unable to meet the financial requirements. Said requirements are 125% of poverty for the last three years, which I have been unable to make because of school. My girlfriends OPT visa expires on Feb. 1 2005. A lawyer told me that if I file the papers now, then the INS would review them in at least 18 months, but my girlfriend would recieve temporary working permission in about 3 months. When the INS reviews my aplication and tells me that I don't qualify finacialy, the lawyer told me that I can then file a joint tax return with my girlfriend as proof of support. Would this work? We need to make a decision soon, thanks!

You can use a co-sponsor to meet the poverty guidelines.
