misdemeanor retail theft and immigration interview for I-485

i have been charged with misdemeanor retail theft $780 .--name removed--am in IL .This is my first offence--name removed--have a court date in January.

--name removed--am married to US Citizen and we have interview scheduled with INS for getting me green card .Interview date is 10 days after the court date ! my attorney said that the only way is to get the case dissmissed and if--name removed--get even supervision--name removed--would be deportable from USA . Is it true that in IL supervision is a deportable issue for INS ? Should--name removed--go tho the Interview with INS ?(even if--name removed--plea Not Guilty and will not be convicted that day so on the day of interview--name removed--will not have conviction yet ?)

I do not believe if you get supervision that you will face deportation, since it is not a conviction. However, my advise to you is to speak with an attorney who handles only immigration matters. There have been many changes in the immigration law and its a Federal issue not a state law issue.
