POwer of Attorney

My room mate has been hospitalized, suddenly for three weeks and will need to go through extensive physical rehabilitation. He was diagnosed with prolonged delerium and isn't able to sign any documents. His sister lives in Arkansas and will be handling his affairs. I am helping her out to find what she will need to do so that his checks can be deposited and bills paid.

Good morning. If your roommate suffers from delerium, he is not competent to sign a power of attorney form. A Disabled Person's Estate should be opened for his benefit. The appropriate Court can appoint a guardian while he is rehabilitating. The guardian will have the authority to pay his bills and negotiate other business on his behalf and will be required to give the Court a written accounting of how money is handled during his disability. You might also contact the bill companies and explain the situation. That will take off some of the time pressure while you figure out the best way to get control of his finances.
