Legal Question in Insurance Law in Illinois
Auto accident
I was in an auto accident three and a half years ago in IL. I was at fault, and the person I collided with sued. Apparently, my old insurance company offered a settlement, and he declined it. Later, he tried to go back to them for another settlement, but they are no longer in business due to bankruptcy. I heard that he is trying to locate me to sue me directly now. Is he able to do that? Isn't that what insurance is for - to not be financially liable unless the amount seeked exceeds the insurance limits?

You might want to check with the state government to see if there is an agency specifically in place to help people in your situation. In Missouri there is the Divsion of Insurance and there is a specific agency set up to protect people. Good luck.
